EC-Council University - CPE Course Terms

This agreement is between EC-Council Inc. (“EC-Council University”/ “we”) and the user who uses our website and/or the student (“you”/“your”/ “student”) who enrolls in the Centre of Professional Education (“CPE Course”) of EC-Council University. These terms are subject additionally to the terms found on our partner website, www.eccouncil.org, our Privacy Policy and our partner’s privacy policy (“Terms”).  By accessing our services in any manner from any device or by clicking “Submit” on a registration, “enrollment” page, or a single-sign-on page (or similar mechanism), you are entering into a legally binding agreement with EC-Council University and its affiliates regarding the use of our Services that binds you and any entity that you may represent.  By accessing the Services, you represent and warrant that you have the right, authority, and capacity to enter into these terms (on behalf of yourself or the entity that you represent).  YOU MAY NOT USE THE SERVICES OR ACCEPT THE TERMS IF YOU ARE NOT AT LEAST THIRTEEN (13) YEARS OLD.  PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICES.  ALL USE OF OUR SERVICES IS EXPRESSLY CONDITIONED ON ACCEPTANCE OF THESE TERMS.  IF YOU DO NOT AGREE WITH THESE TERMS, YOU SHOULD NOT USE, APPLY FOR, REGISTER FOR, OR ACCEPT ADMITTANCE INTO OUR SERVICES, AND YOU ARE NOT PERMITTED TO USE, APPLY FOR, REGISTER FOR, OR ACCEPT ADMITTANCE INTO OUR SERVICES.

Please read through Part A of these Terms to understand the CPE Course and the terms of the enrolment in the Non-credit Certification Course. By submitting the registration form, you consent to EC-Council University and its partners and affiliates collecting your personal information to facilitate the delivery of the certification course you opted for.

Additionally, this website https://staging.eccu.edu/CPE/term-of-use-and-service.html (“Website”) and its services is offered to you conditioned on your acceptance, without modifications, of the terms provided in Part B (“Terms of Use of Website”). Your use of this website and access to services provided on this website shall be governed by the terms stipulated therein.

A. TERMS FOR CONTINUED PROFESSIONAL EDUCATION COURSE

By accepting these Terms, you acknowledge that you have read and agreed to the terms and conditions applicable to your enrollment in the CPE Course. Your enrollment in the CPE Course constitutes your agreement to all such terms, conditions, and notices, as may be updated and changed from time to time. These Terms, along with the associated documents, aim to prioritize the best interests of the students of EC-Council University and our partners and affiliates by defining a well-established procedure for certificate completion.

1. Definitions:
  • “Center for Professional Education (CPE) Course” is the non-credit certification course offered by EC-Council University through its training partners that “certifies” the participant has completed a course or a related group of courses in a subject field, or, where appropriate has met the required course of non-credit study for a specialty of practice.
  • “Non-credit Certification Course” are stand-alone courses or instructional courses that do not offer academic credit.
  • “Non-credit Certification Courseware” shall mean course materials, including but not limited to, course preparation materials, labs, instructor-slides, worksheets, drawings and/or diagrams related to such course materials and any accompanying materials for Continued Professional Education Course, whether bundled with certification examination(s) vouchers or not, in printed, electronic, voice and/or video format in connection with the Continued Professional Educational Course.
2. Scope and applicability:

The CPE terms apply to every student who volunteers to enroll in the CPE Course of EC-Council University. CPE Course endeavors to assist students in upgrading skills and knowledge. The list of all Non-credit Certification Courses provided by EC-Council University can be found on the Website.

3. Eligibility for enrolment:

Individuals who are pursuing a career in IT and cybersecurity, and graduates from a computer science background would benefit the most from the CPE Course of EC-Council University, though the CPE Courses are open for enrollment to any individual who is eighteen years of age. These courses are also open for any professionals who are exploring a transition into the cybersecurity industry and enterprises looking to train their staff in the field of cybersecurity. If any student below the age of eighteen years but above thirteen years of age wishes to enroll then their parents or legal guardian must contact us at [email protected] for more information.

4. How to Register and Enroll?
  • You can click on the selected course and view the details of the course available on the course description page. By clicking on enrollment button, you will be redirected to the payment page, where you are required to fill in the required details and make payment for enrolling in the selected course.
  • Once you have made the payment, you will receive the details on your registered email address.
5. Accessing the Course:

You will have to login through Canvas using your student ID and password to access your course, after receipt of a confirmation of payment on your registered email address. If you are an existing student at EC-Council University, please note that the login credentials for Non-credit Certification Course may be different from EC-Council University’s login credentials for credit programs. Please login using the credentials provided by EC-Council University for the CPE Program. You will have to accept the invitation to view your selected CPE courses. On acceptance, the course will be added to your LMS account. Once you navigate to the course page, you will have access to the learning outcomes and may have to accept additional terms related to your selected CPE course. Access to your courseware may be through third party sites, for which additional user accounts may have to be created. We have tried to document the entire process in a navigation guide which will be made available to each student signing up for CPE course, on request. All information should be received on your registered email address.
You agree that you will never divulge or share access to your account with any third party for any reason. In setting up your account, you may be prompted to enter additional optional information. You represent that all information provided by you is factual, correct, accurate and current. You agree to maintain and update your information to keep it accurate and current.

6. Roles and responsibilities of students for participation
  • It shall be the responsibility of the student to determine the appropriate Non-credit Certification Course based on their area of interest.
  • The student shall fill in the enrollment form for the elected Non-credit Certification Course available on our Website. The description of the course, such as modules, relevant fees, and duration of the course will be available under the relevant course description.
  • To earn the non-credit certification, the student must complete the training for the Non-credit Certification Course and complete the course evaluation forms. The completed evaluation forms will be provided by the student to the course administrator of EC-Council University.
  • Upon completion of training and verification by the instructor, the student will be issued an exam voucher, allowing them to attempt the examination within twelve months from the date of voucher issuance.
  • The student will be provided with the appropriate certificate once they have satisfactorily passed the examination for the enrolled Non-credit Certification Course.
  • You shall not:
    • analyze, decompile, reverse engineer, reproduce, or assist any third party to analyze, decompile, or reverse engineer any information/material that belongs to EC-Council University or its licensors, including but not limited to the Non-credit Certification Courseware, for any purpose whatsoever;
    • replicate any components of the Non-credit Certification Courseware on any platform, including but not limited to e-learning, mobile, electronic, or video-based learning. Any creation of ancillary products like lab solutions, video solutions, e-learning solutions, and exam preparation material for Non-credit Certification Courseware shall be deemed a fundamental breach of this Agreement, and EC-Council University reserves the right to take appropriate legal and disciplinary action to protect its or its licensors' rights;
    • engage in the creation, use, or promotion of any counterfeit, pirated, or illegal copies of Non-credit Certification Courseware;
    • use any robot, spider, scraper, or other automated means to access our services for any purpose;
    • take any action that interferes with or disrupts any service or may impose, in our sole discretion, an undue or disproportionate burden on our infrastructure;
    • bypass any measures we may use to prevent or restrict access to the services including, without limitation, through password mining;
    • use the services to send altered, deceptive, or falsely-sourced information, including, without limitation, by forging TCP-IP packet headers or email headers;
    • upload, transmit, or distribute to or through the services any computer viruses, worms, or any software intended to damage or alter a computer system or data;
    • send through the services unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; and
    • use the services to harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent.
  • You acknowledge that the Non-credit Certification Course is not subject to EC-Council University curricula processes.
  • You acknowledge that the Non-credit Certification Course is a non-accredited course and is not covered by the accreditation provided by the Distance Education Accreditation Commission (“DEAC”) to EC-Council University.
  • You acknowledge that participation in or completion of the CPE Course will not yield credit towards any for-credit degree or program at EC-Council University.
  • You acknowledge that participation in or completion of the CPE Course will not provide you with EC-Council University alumni status.
  • You shall, at all times, comply with applicable laws and ensure that your participation in the Non-Credit Certification Course is not impacting a for-credit degree or program at EC-Council University.
  • You agree and acknowledge that EC-Council University may require you to sign additional documents for your enrollment into the CPE Course.
7. Registration Fees:
  • The fees may vary based on the Non-credit Certification course you have enrolled in. The details of the Non-credit Certification such as course outline, brochure, fees, can be found on the CPE Course website.
  • All fees quoted are exclusive of taxes and you shall be solely responsible for any costs, taxes, levies, bank charges incurred.
  • All fees shall be paid in advance.
8. Refunds

The course fees, minus a 10% cancellation fee per non-credit class, will be refunded if we receive a written request three days prior to the first scheduled class, unless otherwise noted on the course description. No refunds will be issued after this deadline. There is a no drop policy for online, asynchronous courses - no refunds will be issued after registration.

9. Certificate Copies:

If you require a printed copy of the certificate for the enrolled Non-credit Certification Course, you may write to [email protected]. You will need to pay an additional administrative fee of USD 75, excluding applicable customs duties, taxes, levies, and/or surcharges

10. Privacy

EC-Council University recognizes the importance of maintaining your privacy and is committed to protecting it and developing technology that gives you the most powerful and safe online experience. Please read our Privacy Policy located here. We value your privacy and appreciate your trust in us.

11. Third Party Sites

When you enroll in the CPE Course, you will be subject to additional terms imposed by our partners or affiliates. It is your responsibility to comply with such terms including any privacy notice. EC-Council University shall not be responsible for any terms imposed by the partners or affiliates.

12. Third Party Providers

In instances where the CPE Course is provided by or purchased from a partner organization, any questions, concerns, or disputes related to such courses must be addressed directly with the respective partner. EC-Council University and its affiliates shall not be responsible or liable for addressing, resolving, or settling any questions, concerns, or disputes arising from partner-provided courses.

13. The Family Educational Rights and Privacy Act (FERPA)

EC-Council University complies with the Family Educational Rights and Privacy Act of 1974 (FERPA) which requires EC-Council University to allow students to review and request changes to the student’s education records maintained by EC-Council University, notify students at least annually of this inspection right, and maintain records in each student’s file listing requests for access to and disclosures of personally identifiable information. B. TERMS OF USE OF THE WEBSITE

Your use of our Website constitutes your agreement to all such terms, conditions, and notices, as may be notified and changed from time-to-time.

1. Acceptable Use
  • You may use this Website for informational and non-commercial purposes only. You agree not to use the Website to:
    • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

    • Conduct or forward surveys, contests, pyramid schemes or chain letters.
    • Restrict or inhibit any other user from using and enjoying our services or access to the Website.
    • Violate any code of conduct or other guidelines which may be applicable for the use of the Website.
    • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
    • Violate any applicable laws or regulations.
  • EC-Council University and its affiliates has the right, in its sole discretion, to change, modify, adapt, or discontinue any page, feature, content, or other component or element of any course at any time and for any reason, with or without prior notice to you.  All topics, grading or point systems, completion, and all other evaluations and assessments are at our sole discretion.  We reserve the right to restrict your access to some or all of the services at any time for any reason or for no reason, with or without prior notice to you.  You agree that these Terms will apply to any upgrades, changes, or modifications to our services.

  • We do not have an obligation to monitor your use of our Website. However, we reserve the right to terminate your access to any or all parts of our Website at any time without notice for any reason whatsoever.
  • We further reserve the right, at all times, to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in our sole discretion.
  • We do not control or endorse the messages or information if any posted on our Website. We, therefore, specifically disclaim any and all liability with regard to the messages or information posted on our Website.
  • You may view, download for caching purposes only, and print pages from the Website for your own personal use, subject to the restrictions set out in these terms of use.   • The names of actual companies and products mentioned on our Website and electronic assets may be the trademarks of their respective owners.
  • You are prohibited from: (a) Selling, renting, or sub-licensing any material from the Website; (b) Reproducing, duplicating, copying, or exploiting material on the Website for any purposes; (c) Redistributing material from this Website, except for content explicitly and clearly intended for redistribution.
3. Claims Of Copyright Infringement — DMCA Notice

We take claims of copyright infringement seriously and will respond to notices of alleged copyright infringement that comply with applicable law. In accordance with the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”), we will respond expeditiously to claims of copyright infringement committed using our Services. Any dispute or claim relating in any way to your use of the Website will be resolved through courts in New Mexico. By using any the Website, you agree that the laws of New Mexico, without regard to principles of conflict of laws, will govern these Terms and any dispute of any sort that might arise between you and us. Further, the parties specifically exclude the application of United Nations Convention on Contracts for the International Sale of Goods.
Use of the Website is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation this paragraph. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THE TERMS, YOU AND WE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

8. Miscellaneous
  • You agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of these Terms or use of the Website.
  • Our performance of these Terms is subject to existing laws and legal process, and nothing contained in these Terms is in derogation of our right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Website or information provided to or gathered by us with respect to such use.
  • If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms continue in effect.
  • These Terms constitutes the entire agreement between the you and us with respect to the Website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and us with respect to the Website.
  • A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that these Terms and all related documents be drawn up in English.
  • We may transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms of use without notifying you or obtaining your consent. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these Terms.

The Website may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of EC-Council University and EC-Council University is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. EC-Council University is not responsible for webcasting or any other form of transmission received from any Linked Site. EC-Council University is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by EC-Council University of the site or any association with its operators.

10. Modification

These Terms along with the privacy notice, and terms imposed by our affiliates governs your use of our Website and the CPE Program. We reserve the right to change the terms, conditions, and notices under which the Website and/or service is offered, including but not limited to any applicable charges associated with the use of the Website. Continued use of our services following such changes shall indicate your acknowledgment of such changes and agreement to be bound by the terms and conditions of such changes. By continuing to access or use our services after the updated terms are posted, you agree to abide by the updated rerms. In the event that you do not consent and agree to the updated terms, you must discontinue using our services.
